By accessing or using Blue Marble ("the Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services. These Terms apply to all users, including travelers and travel specialists.

2. Description of Service

Blue Marble is a marketplace platform that connects travelers with verified travel specialists. We facilitate introductions and communications but are not a party to any agreements between travelers and specialists. All travel services are provided directly by the specialists, not by Blue Marble.

3. User Accounts

3.1 Account Creation

Travel specialists must create an account to list their services. Travelers can browse and contact specialists without creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Responsibilities

  • You must provide accurate, current, and complete information
  • You must update your information promptly if it changes
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access

4. Travel Specialist Obligations

  • Provide accurate information about your qualifications, specialties, and services
  • Respond to traveler inquiries promptly and professionally
  • Deliver travel services as described in your proposals
  • Maintain appropriate licenses, certifications, and insurance
  • Comply with all applicable laws and regulations
  • Handle traveler information in accordance with privacy laws

5. Traveler Obligations

  • Provide accurate information when contacting specialists
  • Respect the time and expertise of travel specialists
  • Honor agreements made with travel specialists
  • Pay for services as agreed with the specialist
  • Comply with all travel requirements, including visas and health regulations

6. Verification and Quality

We verify travel specialists to the best of our ability, but we do not guarantee their qualifications, services, or outcomes. Verification status indicates that we have reviewed certain credentials, but travelers should conduct their own due diligence. We are not responsible for the quality of services provided by specialists.

7. Payments and Fees

7.1 For Travelers

Our platform is free for travelers. There are no fees to browse, contact specialists, or receive quotes. You only pay the travel specialist directly for their services.

7.2 For Travel Specialists

Travel specialists may be subject to platform fees or commissions as outlined in separate service agreements. All payment terms are handled directly between travelers and specialists.

8. Prohibited Conduct

You agree not to:

  • Use the platform for any illegal purpose
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Post false, misleading, or fraudulent information
  • Spam or send unsolicited communications
  • Interfere with or disrupt the platform's operation
  • Attempt to gain unauthorized access to the platform
  • Use automated systems to access the platform without permission
  • Violate any applicable laws or regulations

9. Intellectual Property

All content on the platform, including text, graphics, logos, and software, is the property of Blue Marble or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY TRAVEL SPECIALISTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLUE MARBLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE PLATFORM.

12. Indemnification

You agree to indemnify and hold harmless Blue Marble, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the platform, violation of these Terms, or infringement of any rights of another party.

13. Dispute Resolution

Any disputes between travelers and travel specialists should be resolved directly between the parties. For disputes with Blue Marble, you agree to first attempt to resolve the matter through good faith negotiation. If not resolved, disputes shall be settled through binding arbitration in accordance with applicable laws.

14. Termination

We may terminate or suspend your account and access to the platform at our sole discretion, without prior notice, for any reason, including violation of these Terms. You may terminate your account at any time by contacting us.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the platform after such changes constitutes acceptance of the updated Terms.

16. Governing Law
